Terms of Service

Last Updated: August 22, 2026

Overview

Welcome to SMALOUIS. The terms “we,” “us,” and “our” refer to SMALOUIS. We operate this store and website, including all related information, content, features, tools, products, and services (collectively, the “Services”), to provide you with a shopping experience.

Our store is powered by Shopify, which enables us to provide the Services to you. These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. They include important information about your legal rights, warranty disclaimers, and limitations of liability. By visiting, interacting with, or using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you must not access or use the Services.

1. Access and Accounts

By using the Services, you represent that you are at least the age of majority in your state or province of residence. If you permit a minor dependent to use the Services on a device you own, purchase, or manage, you are responsible for that use.

You may be asked to provide information such as your email address, billing address, payment information, and shipping address. You represent that all information you provide is accurate, current, complete, and lawfully provided.

You are responsible for maintaining the confidentiality of your account credentials and for all activity occurring under your account. You may not sell, transfer, assign, or license your account to another person.

2. Products

We make reasonable efforts to display our products and services accurately. However, colors, finishes, dimensions, and appearance may vary depending on your device, screen settings, lighting conditions, and other factors.

We do not guarantee that product appearance or quality will exactly match images, descriptions, or your expectations. Product descriptions, availability, and specifications may change without notice. We may discontinue products or limit quantities by person, region, or jurisdiction at our discretion.

3. Orders

When you place an order, you make an offer to purchase the selected products. SMALOUIS may accept or decline an order at its discretion. An order is not accepted until we confirm acceptance and process payment.

Please review your order carefully before submitting it. Once an order has been accepted or entered processing, we may be unable to accommodate cancellation or modification requests.

If we decline, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided at checkout.

Returns and exchanges are governed by our Return & Refund Policy. Products are intended for personal or household use only and may not be purchased for commercial resale or export without our prior written approval.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged is the price in effect when you place your order and will be reflected in your order confirmation.

Unless otherwise stated, listed prices do not include taxes, shipping, handling, customs duties, import charges, or similar fees. Prices on our website may differ from prices offered by third parties or other sales channels.

You agree to provide accurate, current, and complete purchase, payment, and account information. You agree to promptly update your information when needed to complete a transaction or contact you.

By placing an order, you represent that you are authorized to use the payment method provided and agree to pay all applicable charges, including shipping, handling, taxes, and other applicable fees.

5. Shipping and Delivery

Shipping and delivery estimates are provided for convenience only and are not guaranteed. We are not responsible for delays caused by carriers, customs processing, weather, port congestion, or events outside our reasonable control.

Once products are transferred to the carrier, title and risk of loss pass to you, except where otherwise required by applicable law. Please review our Shipping Policy for additional information.

6. Intellectual Property

The Services, including trademarks, logos, text, images, graphics, product reviews, videos, audio, design, layout, and arrangement, are owned by SMALOUIS, its affiliates, licensors, or other rights holders and are protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, transmit, or otherwise exploit any part of the Services without our prior written permission.

Nothing in these Terms grants you a license or other right under any patent, trademark, copyright, or other intellectual property right of SMALOUIS, Shopify, or any third party. All rights not expressly granted are reserved.

7. Optional Tools

We may provide access to tools offered by third parties. These tools are provided “as is” and “as available,” without warranties, representations, conditions, or endorsements of any kind.

Your use of third-party tools is at your own risk and subject to the applicable third party’s terms. We are not liable for any loss or damage arising from your use of optional third-party tools.

Any new features, tools, resources, or services we introduce in the future will also be subject to these Terms.

8. Third-Party Links

The Services may contain links to third-party websites, materials, or embedded functionality. We do not control, review, or endorse third-party content and are not responsible for its accuracy, availability, security, or practices.

If you access a third-party website or enter into a transaction with a third party, you do so at your own risk. Questions or complaints concerning third-party products or services should be directed to the relevant third party.

9. Relationship with Shopify

SMALOUIS is powered by Shopify, which enables us to provide the Services. However, all sales and purchases made through our store are transactions directly between you and SMALOUIS.

Shopify is not responsible for any aspect of your purchase from SMALOUIS, including product-related injury, damage, loss, delivery, returns, refunds, or other matters arising from a transaction with us. To the fullest extent permitted by law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases made from SMALOUIS.

10. Privacy

Personal information collected through the Services is subject to our Privacy Policy. Certain personal information may also be subject to the Shopify Consumer Privacy Policy.

Because the Services are hosted by Shopify, Shopify may collect and process information about your access to and use of the Services in order to provide and improve them. Information submitted through the Services may be shared with Shopify and other service providers, including providers located in countries other than where you reside.

11. Feedback

If you submit ideas, suggestions, reviews, feedback, proposals, plans, or other content (“Feedback”), you grant SMALOUIS a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback for any purpose, including commercial purposes.

You represent that you own or have all necessary rights to submit the Feedback, that any required disclosures of compensation or incentives have been made, and that the Feedback complies with these Terms.

We are not required to keep Feedback confidential, pay compensation for Feedback, or respond to Feedback. We may monitor, edit, or remove Feedback that we determine is unlawful, offensive, defamatory, infringing, misleading, harmful, or otherwise objectionable.

12. Errors, Inaccuracies, and Omissions

Occasionally, the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit times, or availability.

We reserve the right to correct errors, update information, change product details, or cancel orders if information is inaccurate, at any time and without prior notice, including after you have submitted an order.

13. Prohibited Uses

You may use the Services only for lawful purposes. You may not use the Services, directly or indirectly, to:

  • Violate applicable laws, regulations, or local ordinances;
  • Infringe intellectual property, privacy, publicity, or other rights;
  • Harass, abuse, threaten, defame, harm, or intimidate another person;
  • Transmit false, misleading, unlawful, abusive, obscene, or malicious content;
  • Send spam, chain letters, junk mail, or unauthorized promotions;
  • Impersonate another person or entity;
  • Upload viruses, malware, or harmful code;
  • Copy, reproduce, resell, exploit, scrape, extract, or collect data from the Services without authorization;
  • Collect or track the personal information of others;
  • Interfere with, bypass, or circumvent security measures, access controls, CAPTCHA systems, robot exclusion headers, or other restrictions used by the Services.

We may suspend, restrict, disable, or terminate your access to the Services without notice if we reasonably determine that you have violated these Terms.

14. Automated Agents

These Agent Terms apply if you use, enable, deploy, or cause an automated or semi-automated software service, including an AI agent, to access or interact with the Services. An “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of a person or entity.

An Agent may not access or interact with the Services unless it clearly identifies itself and follows these Terms. We may limit or block Agent access through technical or other measures at any time.

Any Agent accessing the Services must:

  • Identify itself in HTTP or HTTPS requests with a user-agent string that includes Agent/[agent name];
  • Not conceal or obscure that it is an automated system;
  • Not imitate human behavior to evade controls or complete or bypass CAPTCHAs or similar safeguards;
  • Respond truthfully to requests intended to determine whether an interaction is conducted by a human or automated system;
  • Not circumvent measures designed to block, limit, modify, or control Agent access to the Services.

15. Termination

We may terminate these Terms or your access to the Services, in whole or in part, at any time and without notice, in our sole discretion. You remain responsible for all amounts due through the date of termination.

Sections that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, feedback, disclaimers, limitation of liability, indemnification, severability, governing law, privacy, and any other surviving obligations.

16. Disclaimer of Warranties

Information on the Services is provided for general information purposes only. We do not guarantee that information on the Services is accurate, complete, current, or useful. Any reliance on such information is at your own risk.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES, REPRESENTATIONS, OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

THIS INCLUDES, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABILITY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow certain warranty disclaimers. In those jurisdictions, some of the above limitations may not apply to you.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SMALOUIS, ITS AFFILIATES, PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, AND SHOPIFY AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES.

This includes, without limitation, damages for loss of profits, revenue, savings, data, goodwill, or replacement costs arising from your use of the Services or products purchased through the Services, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, liability will be limited to the maximum extent permitted by applicable law.

18. Indemnification

You agree to indemnify, defend, and hold harmless SMALOUIS, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from claims, losses, damages, liabilities, and reasonable legal fees arising from:

  • Your breach of these Terms or policies incorporated by reference;
  • Your violation of applicable law or the rights of a third party; or
  • Your access to or use of the Services.

We may control the defense and settlement of an indemnified claim at your expense. You agree to cooperate with the defense of any such claim.

19. Severability

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law. The unenforceable portion will be severed, and the remaining provisions will remain valid and enforceable.

20. Waiver and Entire Agreement

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with policies and operating rules posted on the Services, constitute the entire agreement between you and SMALOUIS regarding your use of the Services and supersede prior or contemporaneous communications and agreements concerning the Services.

21. Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section is void.

SMALOUIS may assign, transfer, or delegate these Terms and its rights or obligations without notice or your consent.

22. Governing Law

These Terms and any separate agreements through which we provide the Services are governed by and interpreted in accordance with the laws applicable in the jurisdiction where SMALOUIS is headquartered. You and SMALOUIS consent to the venue and personal jurisdiction of the applicable courts in that jurisdiction, except where applicable law provides otherwise.

23. Headings

Headings are included for convenience only and do not affect the interpretation of these Terms.

24. Changes to These Terms

You may review the most current version of these Terms at any time on this page. We may update, change, or replace any part of these Terms by posting updates on our website.

We will provide notice of material changes where required by applicable law. Your continued use of the Services after updated Terms take effect constitutes acceptance of those changes.
